How Can I Find Out If I Have a Case?

To determine if you have case, contact our Fort Worth collision lawyers today. We will have some questions about your specific incident – as we need to understand more about the circumstances that led to the crash and caused your injuries. During our free, initial consultation we can discuss your situation and determine if you have a case for financial compensation. We will need to consider various factors, including:

  • Date, location, and time of the crash
  • Details about how the accident happened
  • The type and severity of injuries you suffered
  • Evidence you may have collected, such as pictures of the scene or statements from witnesses

What is the Value of My Fort Worth Car Crash Claim?

Before we can place an accurate value on a car crash claim, we need to understand the unique details about the accident. There are many factors that impact the value of your potential claim, such as the extent of your injuries, your expected long-term prognosis for making a full recovery, lost wages and medical costs.

Typically, car accident victims may be eligible to recover compensation for their:

Our attorneys have extensive experience accurately calculating the value of Fort Worth car crash claims. This is something you can discuss further with one of our knowledgeable attorneys in the free, no-obligation initial consultation that we offer. How Much Do Lawyers Get Paid From a Texas Car Crash Claim?

Like most states, a Texas personal injury lawyer takes between 30 to 40 percent of the total compensation awarded to a car crash victim they represent. That amounts to about one-third of a settlement agreement. For example, if you are awarded $90,000 settlement, and your attorney’s fee is 33 1/3 percent, that is $29,970. Once the attorney fees are deducted from the $90,000, the remaining award would be $60,030.

If your case ends up in court, the fees could be higher, but this is something your attorney will discuss with you.

It is worth mentioning that since we take all injury cases on contingency, including car crash claims, you do not pay these costs or fees out of pocket. The payment to your attorney is taken from the settlement you are awarded, or a jury-awarded verdict if your case goes to trial.

That said, the costs and fees are defined in the contract you sign. You should discuss all costs and fees with your attorney before signing the document. Although your attorney should carefully explain everything in the contract to you, be sure to point out anything that is not clear to you.

How Much Time Do I Have To File a Car Accident Lawsuit in Texas?

In the state of Texas, there is a two-year statute of limitations for most personal injury claims. This means that, after suffering injuries in a car crash or other accident, you have up to two years from the date of the accident to file a claim.

However, some types of claims, such as those against a government agency, may have significantly shorter deadlines.

We strongly recommend that you find out what deadline may apply in your situation by speaking with an attorney as soon after your accident as possible. If you miss your deadline, you will likely be unable to recover any compensation for your damages.

Is Texas a No-Fault State for Car Accidents?

Texas is not a no-fault state when dealing with car accident claims.

Texas is an at-fault, or tort, state when it comes to auto accident cases. That means the driver who caused the crash is responsible for damages suffered by the victim.

Another difference between a tort state and a no-fault state is crash victims have the right to file lawsuits against at-fault drivers. However, most car accident claims are resolved through an insurance settlement because drivers are required to purchase liability insurance.

How Can I Prove the Driver Who Caused The Crash Was Negligent?

To obtain compensation for damages after a car crash in Texas, you or your attorney will need to prove the other driver was negligent. There are four parts to negligence:

  • The at-fault party owed you a duty of care to prevent harm to you and others
  • He or she acted in a way that breached that duty
  • His or her negligent actions caused the crash, resulting in your injuries
  • You suffered real damages, such as medical expenses and lost wages

If you have a valid claim, we are ready to get to work building a case for compensation. If you choose to hire our firm, we will begin an investigation. This often includes reviewing the police report, your medical records, video footage (if available), and other evidence. Our goal is to determine how the other driver’s actions caused the crash that resulted in your injuries and to establish the value of the damages you suffered.

Our Fort Worth auto accident lawyers have investigated a wide variety of car crashes and know what to look for to build a strong case. We have also recovered millions on behalf of our clients.

While you may be unsure about hiring an attorney, you should know that those who do often recover more compensation compared to those who do not. However, it is important to find an experienced attorney with a proven track record.

Can I Pursue Compensation if I Contributed to the Crash?

Even if you contributed to the accident in some way, you may still be able to recover compensation for your damages. In Texas, if both parties share liability for the crash, the accident will be handled under the state’s modified comparative negligence law, which bars recovery at 51 percent. This means that if your degree of fault is 50 percent or less, you may still be eligible to pursue a claim. However, you will have to pay your percentage of liability out of any compensation awarded to you through a settlement or jury verdict.

For example, if you are awarded $100,000 and you are assigned 10 percent of the fault, your compensation award will be reduced by that percentage – $10,000 in this scenario.

If we represent you, our attorneys will fight to make sure you are not assigned more than your fair share of liability for the crash. Contact our firm to discuss other ways hiring an attorney from our firm may benefit your claim.

What Auto Insurance is Required in Texas?

Every licensed driver in Texas is required to carry minimum insurance coverage. This includes liability coverage. If you caused the collision, this portion of your policy pays the medical bills of those injured in the crash, as well as damage to the other driver’s car. If you were injured in a crash, your lawyer would file a claim against the liability coverage in the at-fault driver’s insurance policy.

The minimum amount required in Texas is $30,000 bodily injury per person and $60,000 per accident, as well as $25,000 for property damages per accident. These limits could be too low if you are involved in an accident with more than one vehicle or if the other driver suffers serious injuries. You may consider buying higher limits for better protection of your financial assets – most drivers purchase more than the minimum.

Other coverage you can purchase for additional protection:

  • Collision coverage pays to repair or replace your car after a car crash.
  • Comprehensive coverage compensates you if your car is stolen or damaged in other situations, such as by fire or vandalism.
  • Personal Injury Protection (PIP) helps to pay the medical bills for you and any passengers in your car, as well as lost wages if you cannot work while recovering from your injuries. Unless you reject it in writing, your policy includes PIP coverage.
  • Uninsured/underinsured motorist coverage (UM/UIM) this coverage protects you if you are hit by a driver who is either uninsured or who has too little insurance to cover your medical costs or car repairs. While every insurance company must offer this coverage, if you want to exclude it from your policy, you must do so in writing.

What if the At-Fault Driver is Uninsured or Underinsured?

If the at-fault driver has no insurance, or does not have enough to cover your damages, you may be able to seek compensation from the uninsured or underinsured motorist coverage in your insurance policy.

In Texas, drivers are not required to purchase uninsured motorist coverage. Insurance companies must offer this coverage to drivers, but you can opt out in writing. That said, we do not recommend opting out. For a small increase in your insurance premiums, you can have more protection and more peace of mind.

Another option is to file a lawsuit against the driver. However, this would only work if the at-fault driver has enough assets to cover your damages and most drivers would not.

What Should I Do After Being Involved in A Fort Worth Car Crash?

The first moments after a car accident may be overwhelming and even confusing. Memories fade quickly, especially when it involves a traumatic incident. Collecting information at the scene may provide evidence that can help to strengthen your claim.

Some first steps we recommend, if you can do so safely, include:

  • Call 9-1-1
  • Check yourself and your passengers for serious injuries
  • Cooperate with the police, but do not provide unnecessary details
  • Using caution, take pictures of the scene, vehicle damage and your injuries
  • Exchange contact details with the other driver
  • Get contact details of anyone who witnessed the crash
  • DO NOT talk about the type of insurance coverage you have
  • DO NOT sign any documents to authorize the release of your medical records
  • Keep a record of any communication with your insurance company
  • DO NOT sign any settlement agreements without having an attorney review the offer
  • Contact the lawyers at Anderson & Cummings for guidance immediately after your accident

After being involved in a car accident, you may, per the Texas Transportation Code §550.065, obtain a copy of your accident report. The Tarrant County Sheriff’s Department website provides helpful information about how to get yours.

Handling Insurance Companies

Shortly after being involved in a collision, an adjuster from the insurance company will likely contact you. Despite sounding friendly, it is important to recognize that the insurance representative is not your friend. They have a job to do, which is to settle the claim for as little as possible. This means they may ask you many questions and try to get you to slip up or say something that makes you sound like you are admitting fault.

When an insurance adjuster contacts you, there are a couple of ways you can handle it. You can refer them to your attorney, or you can politely provide basic information with simple, non-detailed statements like:

  • I was involved in an accident on day, date, time
  • I was injured, but do not know the extent of my injuries yet
  • I have vehicle damage, but I am not yet sure how much
  • I will have my attorney call you when there is more information

As soon as you get into answering details, it is easy to make innocent statements that can later be used against you. You should never lie about your injuries or how the car crash occurred, but it is best to wait and give the details to your attorney. He or she understands what the insurance company is looking for and can help you understand the right time and manner to respond without damaging the value of your claim. We can even handle those communications for you.

There are many methods used by insurance companies to try to devalue or deny your claim, so having an attorney on your side to look out for your best interests and legal rights is important and can significantly impact the outcome of your potential claim.
