A heartbreaking crash in Fort Worth claimed the life of a child on Wednesday afternoon after a Trinity Railway Express train collided with a vehicle on the city’s east side. Everyone at Anderson, Cummings & Drawhorn offers sincere condolences to the family facing this devastating loss.

A message from Anderson, Cummings & Drawhorn:
“Any loss of a child is shattering. Our hearts are with this family as they face the unthinkable. In times like this, our role is simply to protect victims from additional harm and help them understand their options. Investigators will look to sort out the mechanism of the tragedy, but someone has to make sure they look beyond the surface and get clarity about the underlying issues. Speaking with an experienced attorney early can make a significant difference in preserving the evidence needed to understand what truly happened.”
Fort Worth police responded shortly before 4:00 p.m. to Elliot Reeder Road and Colony Court, where officers found a heavily damaged vehicle that had been struck by a TRE train. Early information released by police shows the vehicle, which had an adult and a child inside, attempted to drive around an activated train barricade in the moments leading up to the collision. The child died at the scene, and the adult was taken to a local hospital. As of Wednesday evening, police had not released an update on the adult’s condition.
DART issued an alert shortly after the crash advising passengers to expect delays while emergency crews worked along the tracks. The circumstances surrounding the collision remain under active investigation.
Texas continues to see some of the nation’s highest rates of serious transportation incidents, and train crossings are a known risk point. When a crash happens at a railroad crossing, investigators typically look at several key factors, including:
Even when early reports suggest a vehicle went around a barricade, investigators still explore broader safety issues, including whether the warning systems provided adequate time and visibility. These factors often play a role when families start evaluating potential civil claims.
In Texas, families affected by a fatal or catastrophic collision may have the right to pursue compensation for:
These cases can involve multiple parties, including the railway operator, the municipal agencies responsible for crossing maintenance, and others connected to the train’s operation or the crossing’s safety features.
Because each case depends on specific evidence, it is important to seek guidance before signing documents or speaking with insurance representatives. Early evidence preservation plays a major role in determining what happened and who may be responsible.
No Fees Unless We Win
Train collisions tend to result in catastrophic injuries because of the size and speed of the locomotive. Survivors may face internal injuries, traumatic brain injuries, spinal trauma, or symptoms that emerge hours or days after the crash. Families affected by these events often need clarity about medical treatment, time away from work, and long-term recovery.
